By using this website, you confirm that you are at least 18 years of age or have permission from a parent or guardian.
You agree not to use this website or its content for any unlawful purpose, including violating copyright, intellectual property, or other applicable laws.
Any misuse of this website may result in the suspension or termination of access without notice.
Products & Artwork
I strive to display artwork colours, details, and descriptions as accurately as possible. However, colours may vary slightly depending on your device or screen settings.
All artwork descriptions, pricing, and availability are subject to change without notice.
I reserve the right to limit, refuse, or cancel orders where necessary.
Many of my prints are produced to order through professional printing partners and framers. As a result, availability and production times may vary.
Orders & Payment
By placing an order, you agree to provide accurate and complete billing, shipping, and contact information.
I reserve the right to cancel or refuse orders where payment cannot be processed, information is inaccurate, or suspected fraudulent activity is detected.
If an order is cancelled by me, you will receive a full refund for any payment made.
Intellectual Property
All artwork, images, text, designs, branding, and content on this website remain the property of Tracey Bayer Art unless otherwise stated.
Artwork and website content may not be copied, reproduced, distributed, modified, or used commercially without written permission.
Third-Party Services
This website may contain links to third-party websites or services. I am not responsible for the content, policies, or practices of external websites.
Any interaction with third-party websites is at your own discretion and risk.
Limitation of Liability
While every effort is made to provide accurate information and reliable service, I cannot guarantee that this website will always be available, uninterrupted, or error-free.
To the fullest extent permitted by Australian Consumer law, Tracey Bayer Art will not be liable for indirect, incidental, or consequential loss arising from the use of this website, services, or products.

These Terms & Conditions are governed by the laws of South Australia.
Returns, Refunds & Damages
Damaged, Defective, or Incorrect Orders
Although rare, damage can occasionally occur during transit.
If your artwork arrives damaged, defective, or if you receive the wrong item, please contact me within 24 hours of delivery so I can assess the situation and organise a replacement where appropriate.
Please provide photographs of:

The external packaging
-
The shipping label
-
The damaged artwork or frame
Once reviewed, I will arrange a replacement, store credit, gift card, or refund where applicable.
In some cases, return shipping may be required before a refund can be processed. If a return is necessary due to damage or defect, return shipping costs will need to be covered by the purchaser.
Unfortunately, claims submitted more than 24 hours after delivery may not be eligible for replacement or refund.
Cancellations & Order Changes
Because my fine art prints are custom made to order, requests for cancellations or changes must be made within 1 hour of purchase through the website. Once production has commenced the order cannot be modified or cancelled.
Refunds for Approved Cancellations
Where a cancellation or refund request is approved, refunds will be issued to the original payment method.
Please allow up to 10 business days for processing, plus any additional time required by your financial institution.

Change of Mind Policy
As all fine art prints are produced specifically for each order, I do not accept returns, exchanges, or refunds for change of mind after the cancellation period has expired.
Please choose carefully before completing your purchase.
Original Paintings
Due to the unique and high-value nature of original artwork, all original painting sales are final.
Returns, exchanges, and refunds are not available for original paintings unless required under Australian Consumer Law.
Commission Requests
Separate Terms and Conditions are set out for commission requests and are required to be agreed upon and signed by both parties to be binding.
All copyright and intellectual property rights remain the sole property of the Artist unless otherwise agreed in writing.
The Client is purchasing the physical artwork only and does not acquire reproduction rights.
The Client may not reproduce, sell prints of, distribute, alter, or commercially use the artwork without written permission from the Artist.
The Artist may use images of the commissioned artwork for portfolio, exhibition, marketing, social media, and promotional purposes unless otherwise agreed in writing.
Sale Items & Gift Cards
Sale items, discounted products, and gift cards are non-refundable and cannot be exchanged unless required by law.
